be present and should always exercise that right. In the case of a
fatality or other serious injury, it is advisable to have legal counsel
present. Management employees should be advised to answer the
questions asked truthfully, but only answer the question asked,
and to not volunteer information or guess or speculate on questions
they are not sure about. The company representative should
take detailed notes of the questions asked and answers given in the
interview. The inspector may ask the employee to sign a copy of the
inspector’s notes or a statement, but the management employee has
the right not to do so and should always decline.
The closing conference
After the inspection is completed, the inspector will hold a closing
conference to discuss any observed violations. It may occur on the
same day as the inspection or later. The company representative
should attend and be sure to understand and make detailed notes
regarding what the inspector says about the inspector’s findings
and conclusions, including any possible citations or violations. The
company representative should avoid admitting any violations, as
even if the facts are agreed, there may be legal or other defenses
that the company representative is not aware of at the time. The
company representative should determine and understand from the
inspector the deadlines to resolve the inspector’s concerns regarding
any safety hazards observed. Failure to correct an unsafe condition
pointed out by the inspector could result in a willful violation and
higher penalties.
OSHA citations
After the closing conference, there may be citations issued by
OSHA. These are typically sent by certified mail. It is important to
note on the citation the exact date it is received, as there is a strict 15
working day deadline from the date of receipt to try to have the citation
resolved informally with OSHA or to file a Notice of Contest
with OSHA. Failure to timely file a Notice of Contest means that
the citation will become final and may not be challenged. Given
the serious nature of OSHA violations, it is always recommended
to have experienced legal counsel assist you with responding to an
OSHA citation. t
